You Need to Know: ECR Process

Stage 1

If you're notified of a rule violation that falls under the ECR process, the Broker of Record and Listing Salesperson will get a first notice explaining the issue and how to fix it. One business day will be permitted to make corrections before any fines are given. If the problem is fixed by the deadline, no further action is taken.

If the breach is not corrected by the deadline, and the Listing Salesperson has not received a similar notification in the past 2 years, a second notice will be sent out, providing one more business day to make the correction.  If the breach is not fixed within the deadline provided, Professional Standards will be notified.

Stage 2

A second breach of the same MLS® rule within a two-year period will only be given one business day for compliance.  If corrective action is not completed by the deadline, referral to Professional Standards will be required and a Special Administrative Penalty could be issued.

Stage 3

If a member has repeatedly breached the same MLS® Rule within a two-year period, the member will not be subject to the ECR process and will be directed to Professional Standards.
